The Standing Senate Committee on Energy, the Environment and Natural Resources met at 9:05 a.m. this day, the Chairman, the Honourable Ronald D. Ghitter, presiding.

Members of the committee present: The Honourable Senators Adams, Carney, Ghitter, Hays, Landry, Spivak and Taylor. (7)

In attendance: Lynne Myers from the Library of Parliament and Cathy Piccinin, Legislative Clerk, committees and Private Legislation Directorate.

Also in attendance: The Official Reporters of the Senate..

WITNESSES:

From Natural Resources Canada:

Peter Brown, Director, Radioactive Waste and Radiation, Uranium and Nuclear Branch;

Mark Dallaire, Nuclear Technology Advisor, Nuclear Energy, Uranium and Nuclear Branch;

From the Atomic Energy Control Board:

The committee, in compliance with its Order of Reference dated Wednesday, March 5, 1997, proceeded to consider Bill C-23, An Act to establish the Canadian Nuclear Safety Commission and to make consequential amendments to other Acts.

Mr. Brown and Dr. Bishop made opening statements and, together with the other witnesses, answered question.

Mr. Stewart and Mr. Frost made statements and answered question.

At 11:14 a.m., the committee proceeded in camera.

The Honourable Senator Taylor moved, -- THAT the committee's report on the fact-finding visit to Banff be tabled in the Senate as theeEight report of the committee.

The question being put on the motion, it was --

Resolved in the affirmative.

At 11:20 a.m., the committee adjourned to the call of the Chair.

Gordon Edwards, Ph.D., President;

Kristen Ostling, Campaign for Nuclear Phaseout.

The committee, in compliance with its Order of Reference dated Wednesday, March 5, 1997, resumed consideration of Bill C-23, An Act to establish the Canadian Nuclear Safety Commission and to make consequential amendments to other Acts.

Ms Ostling and Mr. Edwards made opening statements and answered questions.

The Honourable Senator Taylor moved, -- THAT the committee proceed to clause-by-clause consideration of Bill C-23, An Act to establish the Canadian Nuclear Safety Commission and to make consequential amendments to other Acts.

The question being put on the motion, it was --

Resolved in the affirmative.

The Honourable Senator Spivak moved, -- the following amendment: In Clause 2 of the Bill, under the definition of "Minister", that the words "Minister of Natural Resources" be replaced by "Minister of the Environment".

The question being put on the motion, it was --

Defeated on the following division: Yeas: 3, Naes: 3, Abstention: none.

The Honourable Senator Taylor moved, -- THAT Bill C-23, An Act to establish the Canadian Nuclear Safety Commission and to make consequential amendments to other Acts, be adopted without amendment but with the following recommendation: The committee unanimously recommends that the government direct that the Canadian Nuclear Safety Commission and Atomic Energy of Canada report to separate Ministers in order to reflect the important distinction between the regulatory aspects of the legislation and the research, development and marketing organization for nuclear energy.

The question being put on the motion, it was --

Resolved in the affirmative.
