The Standing Senate Committee on Aboriginal Peoples met at 4:05 p.m. this day, in Room 505, Victoria Building, the Chair, the Honourable Senator Watt, presiding.

Members of the committee present: The Honourable Senators Adams, Andreychuk, Austin, P.C., Chalifoux, Ghitter, Gill, Johnson, Pépin, Pearson, St. Germain, P.C., Tkachuk and Watt (12).

Other senators present: The Honourable Senators Beaudoin, DeWare, Fraser, Lawson, Perrault, P.C. and Wilson (6).

In attendance: From the Library of Parliament: Mary Hurley and Jill Wherrett.

Also in attendance: The official reporters of the Senate.

Pursuant to the Order of Reference adopted by the Senate on Tuesday, April 13, 1999, the committee continued its examination of Bill C-49, An Act providing for the ratification and the bringing into effect of the Framework Agreement on First Nation Land Management. (See Issue No. 25, Tuesday, April 13, 1999 for full text of the Order of Reference.)

The Honourable Jane Stewart, Minister of Indian and Northern Affairs Canada, made an opening statement. Minister Stewart tabled a letter dated May 12, 1999 to the Chair of the Committee with the Clerk of the Committee, which was retained by the Clerk as Exhibit 5900-1.36/A-1-C-49, 29 "1".

The Honourable Senator Austin moved, -- That the Minister's letter be appended to the committee's report on Bill C-49.

The question being put on the motion, it was agreed.

Minister Stewart, together with Mr. Kerry Kipping, answered questions.

At 5:25 p.m., the committee suspended.

At 5:35 p.m., the committee resumed.

The Chairman invited the committee to begin clause-by-clause consideration of Bill C-49.

It was agreed that the title be postponed.

It was agreed that the preamble be postponed.

It was agreed that clause 1 be postponed.

It was agreed that clauses 2 to 27 carry.

It was moved by the Honourable Senator Austin, -- That Bill C-49 be amended, in clause 28, on page 15:

1. In the English version, replace line 25 with the following:

"other first nation community purposes.".

2. Replace lines 42 and 43 with the following:

"first nation shall apply the rules set out in the Expropriation Act, with such modifications as the circumstances require.".

The question being put on the motion, it was agreed.

It was agreed that clauses 29 to 48 carry.

It was agreed that the schedule carry.

It was agreed that clause 1 carry.

It was agreed that the preamble carry.

It was agreed that the title carry.

It was agreed that the Bill carry, as amended.

It was moved by the Honourable Senator Austin, -- That the steering committee give final approval to the report before presenting it in the Senate.

The question being put on the motion, it was agreed.

At 5:50 p.m., the committee adjourned to the call of the Chair.
