The Standing Senate Committee on Aboriginal Peoples met this day, at 9:04 a.m. in room 160-S, Centre Block, the Chair, the Honourable Thelma J. Chalifoux presiding.

Members of the committee present: The Honourable Senators Chalifoux, Chaput, Gill, Hubley, Léger, Pearson, Phalen, Sibbeston, Stratton and Tkachuk (10).

Other senator present: The Honourable Senator Watt (1).

In attendance: From the Parliamentary Research Branch, Library of Parliament: Mary Hurley, Research Officer.

Also in attendance: The official reporters of the Senate.

Pursuant to the Order of Reference adopted by the Senate on Thursday, September 25, 2003, the committee proceeded to examine Bill C-6, An Act to establish the Canadian Centre for the Independent Resolution of First Nations Specific Claims to provide for the filing, negotiation and resolution of specific claims and to make related amendments to other Acts.

WITNESS:

As an individual:

Peter W. Hutchins, Attorney-at-Law, Hutchins, Soroka & Dionne.

Mr. Hutchins made a presentation and answered questions.

It was moved by the Honourable Senator Chaput that Bill C-6, as amended, be reported to the Senate without further amendment, but with a recommendation that the Federal Interlocutor on Métis and Non-Status Indians bring forward a proposal to deal, in legislative terms, with the Powley decision as soon as possible.

With consent, it was agreed, — That debate on the motion stand until the questioning of the witness has concluded.

Mr. Hutchins answered further questions.

The committee resumed consideration of the motion of the Honourable Senator Chaput.

After debate, the question being put on the motion it was agreed to on the following division:

YEAS: Chalifoux, Chaput, Hubley, Léger, Pearson, Phalen - 6

NAYS: Gill, Stratton, Tkachuk - 3

ABSTENTIONS: Sibbeston - 1

It was agreed, — That the Chair prepare observations to be appended to the report.

At 10:45 a.m., the committee adjourned to the call of the Chair.
