The Standing Senate Committee on Legal and Constitutional Affairs met this day at 4:16 p.m., in room 257, East Block, the chair, the Honourable Joan Fraser, presiding.

Members of the committee present: The Honourable Senators Angus, Baker, P.C., Boisvenu, Carignan, Carstairs, P.C., Fraser, Joyal, P.C., Lang, Rivest, Runciman and Wallace (11).

In attendance: Jennifer Bird and Cynthia Kirkby, Analysts, Parliamentary Information and Research Service, Library of Parliament; and Mona Ishack, Communications Officer, Communications Directorate.

Also in attendance: The official reporters of the Senate.

Pursuant to the order of reference adopted by the Senate on Monday, March 29, 2010, the committee continued its study of Bill S-2, An Act to amend the Criminal Code and other acts (Protecting Victims From Sex Offenders Act). (For complete text of the order of reference, see proceedings of the committee, Issue No. 3.)

WITNESSES:

The chair made an opening statement.

Mr. Rady and Mr. Krongold each made a statement and answered questions.

At 5:30 p.m., the committee suspended.

At 5:33 p.m., the committee resumed.

Mr. Woods made a statement and answered questions.

The Honourable Senator Joyal, P.C., moved:

That the submission from the Barreau du Québec be filed as an exhibit with the clerk of the committee and that the brief be published as an appendix to the committee's proceedings. (5900-3.40/L1-S-2-7,4,"1")

The question being put on the motion, it was adopted.

The Honourable Senator Carstairs, P.C., moved:

That the following material be filed as exhibits with the clerk of the committee:

  • Final Report prepared for Public Safety Canada submitted by witness Bob Dufour at the March 18, 2010 meeting, regarding DNA Identification Act. (Exhibit 5900-3.40/L1-SS-1- 7,1,"1")
     
  • Response from Anthony Tessarolo of Community Safety & Correctional Services to a question taken on notice at the March 18, 2010 meeting, regarding cost effectiveness of DNA testing. (Exhibit 5900-3.40/L1-SS-1-7,1,"2")
     
  • Response from Greg Yost of the Department of Justice Canada to a question taken on notice at the March 17, 2009 meeting, relating to the DNA study. (Exhibit 5900-3.40/ L1- SS-1-7,1,"3")

The question being put on the motion, it was adopted.

At 6:03 p.m., the committee suspended.

At 6:04 p.m., pursuant to rule 92(2)(e), the committee resumed in camera to consider a draft agenda.

It was agreed that senators' staff be permitted to remain in the room during the in camera portion of today's meeting.

It was agreed that the chair seek the authority of the Senate to have all of the papers and evidence received and taken and work accomplished by the Standing Senate Committee on Legal and Constitutional Affairs during its study of Bill S-210, An Act to amend the Criminal Code (suicide bombings), during the Second Session of the Thirty-ninth Parliament, and of Bill S-205, An Act to amend the Criminal Code (suicide bombings), during the Second Session of the Fortieth Parliament, referred to the committee for the purposes of its study on Bill S-215, An Act to amend the Criminal Code (suicide bombings) during the current session.

At 6:17 p.m., the committee adjourned to the call of the chair.
